VAE ( Validation of Experience)
The VAE is one way of acknowledging useful experience in the place of formal qualifications. The decree of 23rd August 1985 allows a candidate to pursue a course for which he does not have the qualifying entrance exam required The decree of 24th April 2002 allows for the attribution of credits towards part or the whole of a diploma/degree. This represents a new means of access to qualification: through validating experience, the VAE leads to the obtaining of a diploma – in part, or completely, other than through training.
Who can ask for the VAE?
Various sections of the population: salaried people, the unemployed, workers of the State, etc In order to satisfy the 2002 decree, it is essential to be able to justify a minimum of 3 years’ experience of work in a field directly related to the diploma sought.
Law of 4 May 2004
This law is now inscribed in the « code du travail » (Laws relating to Employment), the right to « Lifelong Professional Training ». Henceforth, workers can have access to training via three ways:
- With the agreement of the employer, as part of the “Droit Individuel à la Formation.”(An Individual’s Right to Training)
- At the suggestion of the employer, as part of the « Training Plan »
- At the request of the employee within the framework of an individual sabbatical period of training.
An individual’s right to training (DIF) allows all workers with a permanent contract and after a period of at least one year’s experience to benefit from (at his request) 20 hours of training per year over a maximum of 6 years. This new right must be triggered by the desire of the worker, with the agreement of the employer, to follow a particular training. The training does not necessarily have to take place during working hours but is subject to a training grant if it takes place outside working hours.
The Training Plan (PF)
This Training is decided by the employer but can also be suggested by personnel representatives or by individual workers. The law of 2004 distinguishes 3 categories and, under certain conditions, makes allowance for training outside working hours:
- Training « adapted to work activity » : during working hours.
- Training « Evolution and Maintenance of Employment » : where the legal or conventional time of work is lengthened, derogations of remuneration can be applied.
- Training « Development of skills »; training allocation (50% of salary) if training takes place outside working hours.) All salaried workers in a Company have the right to such training.
Individual Sabbatical Period of Training (CIF)
This allows all salaries workers to pursue a period of training of his choice if him whishes, during working hours.
Who can benefit from a CIF ?
All salaried workers with the condition of having worked for at least 24 consecutive months, with 12 months in the Company.
How does a Worker Apply ?
The salaried worker presents his employer with a written request 120 days before the commencement of the course for courses lasting 6 months or more and 60 days if the course is shorter than 6 months. 3 months before the commencement of the course the applicant must submit his dossier signed by the 3 parties (the employer, the training organisation and the salaried worker) to the joint commission organisation.
Who finances the CIF ?
Joint Commissions registered by the State (Fongecif ou OPCA) organise the financing.
Elementary Training : Further or Higher studies after the baccalauréat. Apprenticeship Elementary training through alternating between institution and enterprise.
Continuing Training : Recommencing studies after a break. This concerns people with professional experience, working or registered as unemployed.
